Terms of Service

Agreement to terms

By accessing or using Dammit ("the Service"), operated at dammit.app, you agree to these Terms of Service. If you do not agree, do not use the Service.

"We", "us", and "our" refer to Dammit and its operator. "You" refers to the person or organisation using the Service.

What Dammit does

Dammit is a digital asset management layer that sits on top of Google Drive. It provides visual browsing, tagging, rights management, and shareable Portals for your Google Drive files.

Dammit does not store your files. All file binaries remain in Google Drive. Dammit reads file metadata (filenames, types, folder structure, modification dates) and generates cached thumbnails for display. We do not download, copy, modify, or delete your Drive files unless a specific feature explicitly states otherwise and you opt in.

Account terms

To use Dammit, you must sign in with a Google account. You are responsible for maintaining the security of your Google account credentials. Dammit does not have access to your Google password.

Each user belongs to a single workspace. When you first sign in, a workspace is created for you automatically unless you have a pending team invitation.

You must be at least 16 years old to use the Service. By creating an account, you confirm you meet this age requirement.

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, contact us immediately at support@dammit.app.

Acceptable use

You agree to use Dammit in compliance with all applicable laws. You must not:

  • Use the Service to manage, distribute, or organise content that is illegal, harmful, or infringes on the rights of others
  • Attempt to gain unauthorised access to other users' workspaces or data
  • Interfere with or disrupt the Service, its servers, or connected networks
  • Use automated scripts, bots, or scrapers to access the Service beyond its intended API
  • Resell, sublicense, or redistribute the Service without written permission
  • Use the Service in a way that violates Google's Terms of Service or Drive API terms

We reserve the right to suspend or terminate accounts that violate these terms, with notice where practicable.

Plan and billing terms

Dammit offers a free trial period. After the trial, continued access requires a paid subscription. Plan details, pricing, and feature limits are displayed on our pricing page and may change with notice.

Subscriptions are billed on a recurring basis (monthly or annual, depending on the plan you select). Payment is processed at the start of each billing period.

We will notify you of any pricing changes at least 30 days before they take effect. If you do not agree with a price change, you may cancel before the next billing period.

Cancellation and data handling

You may cancel your subscription at any time. Upon cancellation:

  • Your access continues until the end of the current billing period
  • After the billing period ends, your workspace enters a read-only grace period (30 days) during which you can export your data
  • After the grace period, your workspace and all associated data (metadata, tags, rights classifications, cached thumbnails, team invitations, activity logs) will be permanently deleted
  • Your files in Google Drive are never affected - we do not modify or delete Drive files

If you want your data deleted immediately rather than waiting for the grace period, email us at support@dammit.app and we will process the deletion within 30 days.

Google Drive data disclaimer

Dammit connects to Google Drive using Google OAuth. We request drive.readonly scope at sign-in for reading file metadata, and optionally the drive scope if you enable write features (file renaming, inboxes). Write access is requested incrementally - only when you choose to enable it.

  • We read file metadata and thumbnails from your connected Shared Drive
  • We cannot access files outside the Shared Drive you explicitly connect
  • We do not access your personal My Drive, Gmail, or other Google services
  • Write access (when granted) is used only for renaming files and uploading files from external contributors via inboxes
  • You can disconnect your Drive from Dammit at any time via Settings, or revoke access from your Google account

You can revoke Dammit's access to your Google account at any time via your Google Account permissions page. Revoking access will disconnect your Drive from Dammit but will not delete your Dammit workspace data - contact us to request that separately.

Intellectual property

You retain all ownership of your content. Dammit does not claim any rights over the files in your Google Drive or the metadata you create within the Service.

The Dammit name, logo, and the Service itself are our intellectual property. You may not use our branding without written permission.

AI features

Dammit uses Google Gemini AI to provide auto-tagging, semantic search, and brand color extraction features. When these features are active:

  • Cached thumbnail images may be sent to Google Gemini for tag generation and color extraction
  • Asset metadata (filenames, descriptions, tags) may be sent to Google Gemini for search relevance ranking
  • No original file contents are shared with any AI provider
  • AI-generated tags are suggestions - you have full control to accept, modify, or reject them

Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to:

  • Loss of data, revenue, or business opportunities
  • Interruptions to the Service or loss of access to your workspace
  • Errors in AI-generated tags or classifications
  • Actions taken by Google regarding your Drive files or account
  • Unauthorised access resulting from your failure to secure your Google account

Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you via email or an in-app notice at least 30 days before they take effect.

Continued use of the Service after changes take effect constitutes your acceptance of the revised terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
